ACP-5 Filing for Mount Vernon Owners With Bronx and City Projects
When the renovation is across the line in New York City, get the asbestos survey and signed assessment report the permit application depends on.
Where the ACP-5 Applies, and Where It Does Not
Mount Vernon is a separate city in Westchester County, and asbestos jobs within its borders answer to the state's Industrial Code Rule 56 with no ACP-5 in the picture. A few blocks south, though, the Bronx begins, and plenty of Mount Vernon owners, landlords and contractors have buildings or jobs on that side of the line. Once you cross into city territory, DEP layers its own asbestos program over the state requirements. Before the Department of Buildings will issue most permits, a DEP-certified asbestos investigator has to survey the area the work will disturb and sign an Asbestos Assessment Report, the ACP-5, stating that no regulated asbestos will be affected. Should the survey find asbestos in the path of the work, that material is abated under its own notification before the permitted job can go forward. We handle the survey, the signed report and any abatement it triggers, so the permit does not sit waiting on asbestos paperwork.
What ACP-5 Work Includes
From the first survey to a filed report, plus abatement if the survey finds something.

Sampling and lab analysis
Anything doubtful cut and sent for laboratory analysis.
The signed assessment report
An ACP-5 prepared and signed by the certified investigator.
Filing with the permit
The report filed so it supports the Department of Buildings application.
Abatement when required
Removal under a project notification before permitted work begins.
Your architect and expediter looped in
Dates and documents shared so the permit package stays consistent.
How the ACP-5 Gets Done
Project details
The building, the borough, the scope of work and where the permit application stands.
Survey and samples
The investigator inspects the area and samples anything suspect.
File or abate
If no regulated asbestos will be disturbed, the ACP-5 is filed; if it will be, abatement comes first.
